Welcome to Listava
These Terms of Service ("Terms") govern your use of Listava, an email list service
operated by MediaStable. By using our service, you agree to these terms.
Our Service
Listava provides email list management and distribution services. We help you:
- Create and manage email lists
- Send messages to your list members
- Track basic email delivery metrics
- Manage subscriptions and unsubscribes
Account Responsibilities
You are responsible for:
- Providing accurate and current information
- Maintaining the security of your account
- All activity that occurs under your account
- Obtaining proper consent from list members
Free Account Limitations:
- Free users can own only one active list at a time
- Standard rate limits and usage restrictions apply
- Service availability is provided on a best-effort basis
Acceptable Use
You may not use Listava to:
- Send spam, unsolicited emails, or bulk commercial messages
- Distribute malware, viruses, or harmful content
- Violate any laws or regulations
- Infringe on intellectual property rights
- Harass, threaten, or abuse others
- Impersonate others or provide false information
- Attempt to gain unauthorized access to our systems
Email Content Requirements:
- All recipients must have explicitly consented to receive emails
- Include clear unsubscribe instructions in every email
- Honor unsubscribe requests promptly
- Comply with CAN-SPAM Act and other applicable laws
Content and Data
You retain ownership of all content you submit to Listava. By using our service, you grant us:
- Permission to store, process, and transmit your content
- Rights necessary to provide and improve our service
- Ability to comply with legal requirements
Service Availability
We strive to provide reliable service but cannot guarantee 100% uptime. We may
temporarily suspend service for maintenance, updates, or to address security issues.
We are not liable for any downtime or service interruptions.
Termination
Either party may terminate this agreement at any time:
- You may: Delete your account and stop using our service

We may: Suspend or terminate accounts that violate these terms
Upon termination, we will delete your data according to our Privacy Policy,
except for information we're legally required to retain.
Disclaimers and Limitations
Service provided "as is":
We provide Listava without warranties of any kind.
We disclaim all warranties, express or implied, including merchantability and fitness
for a particular purpose.
Limitation of liability:
Our liability is limited to the maximum extent
permitted by law. We are not liable for indirect, incidental, or consequential damages.
Changes to Terms
We may update these terms from time to time. We'll notify you of material changes
by email or through our service. Continued use after changes become effective
constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of New Mexico, United States. Any disputes
will be resolved in the courts of New Mexico.
